Twenty percent of transgender people face discrimination when seeking a home and more than 10% have been evicted because of their gender identity. At the same time, one in five transgender individuals have experienced homelessness at some point, and transgender and other LGBQ-identified youth make up an estimated 20-40% of the homeless youth population.
It is illegal for a housing provider to do any of the following because of your gender identity or because you are perceived as not conforming to gender stereotypes:
• Refuse to admit you to a homeless shelter
• Tell you housing is unavailable when it is available
• Set different terms, conditions, or privileges for sale or rental of a dwelling
• Provide different housing services or facilities
• Deny you a mortgage loan, or impose different terms or conditions on a mortgage loan
• Deny you property insurance
• Conduct property appraisals in a discriminatory manner
• Harass, coerce, intimidate, or interfere with you exercising your fair housing rights
And you should never face discrimination because of race, color, national origin, religion, familial status, or disability (including if you are, or are perceived as, a person living with HIV/AIDS). In addition to these protections, federally-funded housing cannot discriminate on the basis of gender identity, sexual orientation or marital status.
